Judge Issues Strong Warning to Lawyers in NAM1, Menzgold Trial

The judge presiding over the trial of Nana Appiah Mensah (NAM1), the embattled CEO of Menzgold Ghana Limited, has issued a stern warning to lawyers involved in the case.

Justice Ernest Owusu-Dapaah, a Court of Appeal judge sitting as an additional High Court judge, threatened to imprison lawyers who fail to show proper courtesy to the court.

According to a report by Daily Guide, Justice Owusu-Dapaah emphasized that he would not tolerate any disrespect from the lawyers and asserted his authority to use the powers granted to him by the constitution.

He stated that if the disrespect continues, he will hold lawyers in contempt of court and send them to prison, asserting that not even the President can influence such a decision.

The warning came after a prolonged exchange between the Director of Public Prosecutions, Yvonne Atakora Obuobisa, and Kwame Akuffo, counsel for NAM1 and his companies. The ongoing trial involves NAM1 and two of his companies facing charges of defrauding by false pretence, inducing the public to invest, and money laundering.

During the proceedings, the defense raised objections about a witness speaking Twi instead of English, which led to a heated argument between the prosecution and defense lawyers. Justice Owusu-Dapaah intervened, cautioning that continued misconduct could result in lawyers being charged with contempt of court and imprisoned.

He emphasized the need for lawyers to respect the authority of the court, highlighting that he is exercising the sovereignty of Ghana and expects full cooperation from legal practitioners.

The judge stated that he is focused on determining the truth in the case and urged lawyers to maintain a respectful atmosphere in the courtroom.

The trial was adjourned to January 23, 2024, for the prosecution to call its fifth witness.
